Found Direct Deposit Bonus Terms

Welcome to the “Found Direct Deposit Bonus Program”!

These Found Direct Deposit Bonus Program Terms (these “DD Bonus Terms”) govern your (“you”) participation, access, and use of the Found Direct Deposit Bonus Program (“DD Bonus Program”) and are incorporated into the Found Terms of Service between Found and you. 

For the purposes of these DD Bonus Terms, the Found Terms of Service, the Found Privacy Policy and any other terms and policies referenced in those documents are referred to together, as the “Found Terms”. For the purposes of these DD Bonus Terms, “Found”, “we”, or “us” refers to Found.

We urge you to carefully read these DD Bonus Terms and the Found Terms as they govern your participation in the DD Bonus Program and constitute a legally binding agreement between you and Found. Capitalized terms used in these DD Bonus Terms without definition shall have the meanings ascribed to them in the Found Terms. THIS IS A PROMOTIONAL PROGRAM BASED ON YOUR ABILITY TO RECEIVE ELIGIBLE DIRECT DEPOSITS (DEFINED BELOW). IF THERE IS ANY CONFLICT BETWEEN THESE BONUS TERMS AND THE FOUND TERMS, THESE BONUS TERMS SHALL GOVERN WITH RESPECT TO THE BONUS PROGRAM ONLY, AND THE FOUND TERMS SHALL GOVERN IN ALL OTHER MATTERS.

Found is not a bank. Found provides you with access to products and services provided by third parties, including Piermont Bank, Member FDIC, (“Sponsor Bank”) that offers Found-branded banking products and services. Some services related to these DD Bonus Terms may be provided by Sponsor Bank.

1. Acceptance of Terms

By participating in the DD Bonus Program or receiving an Eligible Direct Deposit, you acknowledge that your participation in the DD Bonus Program is subject at all times to the Found Terms, including these DD Bonus Terms, and you agree to be bound by them. If you do not accept these DD Bonus Terms in their entirety, you may not participate in the DD Bonus Program.

2. DD Bonus Program Overview

The DD Bonus Program enables you to earn cash (a “DD Bonus”) for receiving direct deposits into your Found account (“Found Account”). Your Found Account remains subject to the Piermont Business Account and Mastercard Terms.

3. Modification or Changes to DD Bonus Terms or DD Bonus Program; Cancellation

The DD Bonus Program, these DD Bonus Terms, and any aspect thereof are subject to change or cancellation by Found at any time, with or without advance notice to you. Found may amend or update these DD Bonus Terms at any time by posting a revised version here or through other communications. By continuing to participate in the DD Bonus Program after such changes, you are indicating that you accept modifications or changes to the DD Bonus Program.

4. Eligibility

You may only participate in the DD Bonus Program and receive a DD Bonus if you are:

• A Found user with a Found Account and a Found Card;

• Over 18 years old and in each case have registered with Found;

• Not in violation of any international, national, state, or local law or regulation as applicable to your eligibility to participate in the DD Bonus Program in whole or in part;

• In compliance with the Found Terms, including without limitation, maintaining one Found Account in good standing for the duration of your participation in the Bonus Program; and

• In compliance with these DD Bonus Terms.

We have sole direction to determine if you are eligible to participate in the DD Bonus Program and may suspend, restrict, or otherwise terminate your access to the DD Bonus Program at any time.

5. DD Bonus for Eligible Direct Deposits 

(a) Direct Deposits. 

(i) Eligible Direct Deposits: An “Eligible Direct Deposit” includes any electronic ACH transfers of payment directly from (1) employer, payroll, or benefits providers, (2) Uber, Airbnb, Instawork, or other 1099 earnings platforms, (3) Stripe, Square, Bankcard, or other merchant services providers, (4) eBay, Amazon, Shopify or other ecommerce platforms, or (5) other payers associated with a promotional code as defined below. For each Eligible Direct Deposit, you will receive a credit balance towards earning a DD Bonus.

(ii) Ineligible Direct Deposits: Any of the following (collectively, “Ineligible Direct Deposits”) are not Eligible Transactions and will not count towards your earning of a Bonus: (1) any transfers or payments from Cash App, Venmo, PayPal, Coinbase, Binance, or any other digital or cryptocurrency wallet provider, (2) any transfers or payments from a bank, credit union, brokerage, lender, banking service provider, or cash advance provider, (3) any transfers or payments from Wise, Xoom, or any other money transfer service, (4) any transfers or payments from BetMGM, Jackpocket, or any other gambling service, (5) any direct deposit that is cancelled, disputed, reversed, or otherwise rejected for any reason, or (6) any direct deposit that in Found’s discretion is in violation of these DD Bonus Terms, fraudulent, or misleading. Found retains the right to update or revise the types of direct deposits that constitute Ineligible Direct Deposits at any time.

(b) Promotional Code. Found may, in its sole discretion, create promotional codes (“Promo Codes”) that may be linked to or provided by certain third party partners (“Third Party Partners”). For example, if you enter a Direct Deposit Bonus Promo Code from a Third Party Partner you will have the ability to earn a DD Bonus if you receive the requisite Eligible Direct Deposits as described to you when you received the Promo Code. You agree that Promo Codes: (i) may not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public form or otherwise), unless expressly permitted by Found; (ii) may be disabled by Found at any time for any reason without liability to Found; (iii) may only be used pursuant to the specific terms that Found establishes for such Promo Code; and (iv) may expire prior to your use. Found reserves the right to withhold or deduct credits or other features or benefits obtained through the use of the Promo Codes by you or any other user in the event that Found determines or believes that the redemption of the Promo Code was in error, fraudulent, illegal, or otherwise in violation of DD Bonus Terms.

(c) DD Bonus. Within the App or at the time you receive your Promo Code, you will be provided with the eligibility requirements for a DD Bonus which may include (i) the number of Eligible Direct Deposits required for a DD Bonus (ii) the required amount of each Eligible Direct Deposit; (iii) the period of time that each Promo Code will be eligible, (iv) the amount of the DD Bonus or (v) other terms as provided by Found or a Third Party Partner. If a DD Bonus is earned it will be provided as a credit into your Found Account. 

(d) Timing. Please ensure that your Found Account is in good standing and not dormant, cancelled, or closed to allow us to deposit any applicable DD Bonus to your Account. We may delay disbursing DD Bonus for a variety of factors, including without limitation: (i) the number of DD Bonuses we need to process; (ii) the completeness of any additional documentation we may request to process the DD Bonus; and (iii) other circumstances that may delay disbursements.

(e) Disclaimer. Found is not responsible for attempted direct deposits that are not successful for any reason. There are no restrictions on the number of qualified Eligible Direct Deposits you can make in accordance with these DD Bonus Terms. Found’s team will aim to review Eligible Direct Deposits on a regular basis. Found retains sole discretion in determining which Eligible Direct Deposits are qualified according to these DD Bonus Terms.

(f) Discrepancies. You must notify us using the “Contact Us” information of any discrepancies in your Found Account within thirty (30) days of the activity date. Requests must include your name, and supporting documentation as we may request.

(g) Restrictions. 

i. WE MAY IMPOSE RESTRICTIONS AND LIMITATIONS ON ELIGIBILITY FOR BONUS PROGRAMS INCLUDING ANY OF THE RESTRICTIONS DESCRIBED HEREIN. 

ii. Your DD Bonus cannot be combined, accrued or transferred from multiple Found Accounts (including those of family members) or other sources into a single Found Account.

iii. The granting of any DD Bonus as part of the DD Bonus Program is within Found’s sole discretion and all decisions related to the DD Bonus Program are final and non-appealable. We may delay, suspend, or restrict any DD Bonus if we reasonably determine that such action is necessary to comply with applicable law or our internal compliance standards.

6. Your Responsibilities and Use Restrictions

You agree not to do any of the following in connection with your participation in the DD Bonus Program:

• Attempt to or maintain more than one Found Account;

• Execute or attempt to execute any denial of service;

• Interact with any third parties (which includes modifying or accessing data from such third party) if such third party has not consented to such action;

• Spam or use any automated vulnerability tools that may generate large traffic volume;

• Exploit any vulnerabilities you discover in any way for any reason, including exploitation of any data uncovered by way of such vulnerability;

• Engage in social engineering (including “phishing”) of Found staff or contractors, or otherwise;

• Violate any other applicable laws or regulations, including those prohibiting unauthorized access to data;

• Physically attempt to gain access to Found property; and

• Disclose any personal, financial, or location information publicly; or

• Violate any other use restriction contained in the Found Terms.

You agree to do all of the following in connection with your participation in the DD Bonus Program:

• Inform us as soon as possible upon discovery of any error, vulnerability, or other bug (“Errors”) whether such Errors are outside of the scope of the DD Bonus Program or not; and

• Avoid disruptions to others, including but not limited to unauthorized access to or destruction of data, theft, and interruption or degradation of our services.

If you violate these DD Bonus Terms, you may be prohibited from participating in the DD Bonus Program and future Found programs, and any Eligible Direct Deposits you have provided may be deemed to be ineligible for a DD Bonus.

7. Tax Information

You understand that it you are responsible for determining and obtaining appropriate tax treatment for any DD Bonus you receive, and you are solely responsible for any taxes arising from or related to any DD Bonus you receive as a result of participating in any DD Bonus Program. By participating in any DD Bonus Program, you hereby release and indemnify Found from any liability for any such taxes. Found will not report any income or earnings related to DD Bonus to a taxing authority, except where expressly required by law. We may require you to provide certain tax information in order for you to participate in a DD Bonus Program. The information you provide may include identifying information including your name, location, and tax status. Failure to provide Found with accurate or properly completed tax forms may result in the withholding of tax on DD Bonuses made by Found or your ineligibility to participate in the Bonus Program or DD Bonuses. Importantly, any tax form provided to Found must be submitted in the manner either provided by Found including, without limitation, a signature certifying the accuracy of the IRS Form W-8, or as reasonably acceptable to Found.

8. Termination

Found shall have the right, at its sole discretion, to terminate this DD Bonus Program immediately with or without cause upon written notice to you. In addition, these DD Bonus Terms and the DD Bonus Program shall terminate automatically upon any termination of the Found Terms between you and Found. Any DD Bonus earned prior to such termination will be paid to you as detailed herein. 

9. Miscellaneous

Found’s failure to enforce any right or provision of these DD Bonus Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Found. Except as expressly set forth in these DD Bonus Terms, the exercise by either party of any of its remedies under these DD Bonus Terms will be without prejudice to its other remedies under these DD Bonus Terms or otherwise.
